Comparative Law: Proportionality - LAW 639
2 Hours "In many countries (e.g., Canada,Germany,Spain, Israel ) and under some international documents ( e.g., The European Convention for the Protection of Human Rights and Fundamental Freedoms ),a statute can effect human rights only if it is proportional ( that is, suitable and necessary to achieve legitimate governmental ends and is properly balanced. The course will look into the concept of proportionality,its scope, history and rationality. It will do so on a comparative law basis. It will compare it to the American levels of scrutiny.
