Alabama Law Review Symposium – The End of Animus: The Lifespan of Impermissible Purposes

A tremendous amount of scholarship and jurisprudence has explored the nature of animus, among other forms of invidious or improper governmental intent. Much less discussed, however, has been the question of how long such a finding should remain in effect and what, if anything, can or should be done to “cure” it. This symposium addresses that important constitutional question: When does the taint of animus from the original enactment continue to apply, and when has the later and ostensibly legitimately motivated law effectively neutralized that taint?
