Special Topics in Law: Regulation of Alcoholic Beverages - LAW 731

2 Hours

Focusing primarily on beer and wine this course examines the tri-level legal (local, state, and federal) regulation of alcohol production, distribution, and sale. Among the issues discussed will include the relation of the commerce clause with the 21st Amendment; the taxation of alcohol at all three levels of government; local regulation of distillers and vintners; and the interaction between the 1st Amendment and regulation of liquor advertisement. Other topics that we will touch on include the trademarking of alcohol names (e.g. champagne), labeling, distribution limitations, and liabilities of alcohol producers.
